The advanced age and poor health of a Florida mobster convicted of racketeering charges recently resulted in a reduction of his prison sentence in a Fort Lauderdale federal court. According to a report in the Miami Herald, the 78-year-old mobster had a 14-year prison sentence cut in half and got another 6-month sentence reduction because of his age, declining health and his cooperation with authorities.

The cooperation with the court system was an apparent change of heart by the man, who previously swore he would never help prosecutors. The man had pleaded guilty to racketeering conspiracy for his part in criminal activities in Florida. His criminal defense lawyers successfully argued that, at his advanced age and poor health condition, the additional six months in prison would not accomplish anything for the state.

In this special case, U.S. District Judge James Cohn agreed and stated that the punitive and deterrent aspects of the previous court sentence had been met. He further stated that the man's health conditions were a factor in granting this sentence reduction.

As long as the community and the people receive fairness in the judging of criminal matters, the system and the people benefit. Anyone accused of criminal activities is best served by having an experienced criminal defense attorney representing their case in court. Special circumstances do exist that may result in fair justice and a lesser sentence. Innocent persons must seek out the services of an excellent criminal defense lawyer who will stand up for their rights to a fair trial and judgment.
